Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Best Note’s website, browser extensions, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.
1. The Service
Best Note is a local-first rich note and web clipping tool for supported browsers. Free features work offline on your device. Optional Pro features add end-to-end encrypted cloud sync and related capabilities when available.
2. Eligibility
You must be legally able to enter a binding agreement in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind it.
3. Accounts
- An account is required only for Pro / sync features.
- You are responsible for safeguarding credentials and encryption secrets (password and recovery words).
- We cannot recover your encryption password or recovery words. Loss may make encrypted notes unrecoverable.
- Provide accurate information and notify us of unauthorized account use at support@bestnote.app.
4. Your content
- You retain ownership of notes and content you create or clip (“User Content”).
- You grant us a limited license to host and process encrypted Pro sync data solely to provide the Service.
- You are responsible for User Content and for having rights to capture/store it.
- Do not use the Service to store or transmit unlawful content.
5. Acceptable use
You agree not to:
- Abuse, disrupt, or reverse engineer the Service except as allowed by law
- Attempt to access other users’ data
- Circumvent subscription, rate limits, or security controls
- Use the Service for malware, spam, or illegal activity
6. Subscriptions & billing
- Pro is offered as a paid subscription (for example monthly or yearly) when checkout is enabled.
- Prices are listed on the Pricing page and may change for new purchases.
- Payments may be processed by a third-party Merchant of Record. Their terms apply to payment processing.
- Taxes may be added based on your location.
- Subscriptions renew automatically until canceled.
- Cancellation stops future renewals; access continues until the end of the paid period unless otherwise stated.
- Refunds are governed by our Refund Policy.
7. Free tier
Free features are provided as-is and may change. Free use is local-only and does not include multi-device encrypted sync.
8. Intellectual property
The Service, branding, and software (excluding User Content) are owned by Best Note and its licensors. These Terms do not grant you rights to our trademarks or source code except the license to use the published extension builds.
9. Third-party services
The Service may integrate third parties (for example authentication, hosting, payments, browser platforms). Their terms and privacy policies apply to their services.
10. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. Maintain your own backups of important notes.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEST NOTE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
12. Indemnity
You will defend and indemnify Best Note against claims arising from your User Content or misuse of the Service, to the extent permitted by law.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms, risk to the Service, or non-payment. Provisions that should survive termination will survive.
14. Changes
We may modify the Service and these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
15. Governing law
These Terms are governed by applicable laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law rules, unless mandatory consumer protections in your country provide otherwise.
